Democrats gained an ally in their lawfare against President Trump.
This is bad news for the future of the Trump administration.
And a Supreme Court Justice declared war on Trump with this insane ruling.
At this point, Chief Justice John Roberts is a full-on resistance liberal.
Roberts already sided against Trump in the tariff and birthright citizenship case.
Now Roberts sided with the court’s three liberal justices in dissenting from a 5-4 decision allowing President Trump to proceed with renovating the East Wing of the White House to build a new ballroom and military complex.
The majority rejected the suit on the grounds that a liberal activist lacked standing to sue to stop the ballroom construction simply because looking at the project made her angry.
Roberts ignored the fact that the administration cited three separate statutes authorizing the project to falsely claim that Trump exceeded his authority.
“Pursuant to its plenary constitutional authority over the District of Columbia and federal property, Congress has explicitly prohibited the construction of any “building or structure… on any reservation, park, or public grounds of the Federal Government in the District of Columbia without express authority of Congress.”. 40 U. S. C. §8106. The ballroom is a building or structure being erected on federal park grounds—President’s Park—in the District of Columbia. Yet Congress has not passed any law resembling “express authority” for the Executive’s construction of it,” Roberts wrote.
Roberts then pitched a fit in his dissent with a screed that amounted to him complaining that Trump was the one overseeing the project.
“As President Theodore Roosevelt once remarked while thanking Congress for expressly appropriating funds for the construction of the East and West Wings: “The stately simplicity of [the White House’s] architecture is an expression of the character of the period in which it was built, and is in accord with the purposes it was designed to serve. It is a good thing to preserve such buildings as historic monuments, which keep alive our sense of continuity with the Nation’s past.” …” Roberts added.
“The White House is not just any building, and—when it comes to historic preservation—[Plaintiff] is not just any person. In failing to appreciate as much, the Court misconceives the plaintiff’s injury, allowing the Executive’s likely infringement of the Legislature’s power of the purse and authority to regulate federal property in the District of Columbia to continue. Today’s decision is no victory for the separation of powers,” Roberts added.
Roberts really couldn’t make a legal argument that a random liberal could sue the federal government because she was angry at Trump, so he cited Winston Churchill.
“Winston Churchill once remarked that ‘ We shape our buildings, and afterwards our buildings shape us.” All the more reason to ensure that those responsible follow the rules in deciding what to tear down and what to build up at the People’s House,” Roberts continued.
Roberts is going to be a thorn in the side of Trump for the remaining 28 months of his Presidency and for Republicans for years to come.
It’s clear Roberts is a Never Trump RINO who despises the Trump GOP and his leftward drift, which began with his Obamacare ruling in 2012, is now complete.
